The Spanish Tax Administration has been developing in recent years a campaign of inspections against lawyers who work for companies in which they participate as partners. This trend also extends to companies of professionals in other fields (doctors, engineers,…).
Unfortunately, not even in cases in which the real existence of the company, its necessity and the existence of material and human resources in it have been demonstrated, has this tendency to indiscriminately initiate acts based on the delicate legal institution of simulation been stopped.
